In July 2012, the Court of Justice of the European Union (CJEU) issued several important rulings. Among these, one ruling concerned Italy's failure to collect and treat urban wastewater, in compliance with Directive 91/271/EEC. In another case, the Court ruled that software licenses cannot be broken down and sold individually. Furthermore, a ruling was issued regarding access to commercial documents relating to software licenses, including used licenses.
Software Licenses:
The software licenses ruling (Case C-128/11) clarified that the rights to exploit copyrighted software can be transferred to third parties, as established by Article 4(2) of Directive 2009/24/EC. This means that authorized resellers and consumers can purchase and resell used software licenses, under certain conditions.
Access to Documents:
The ruling also established that third parties, such as consumers, authorized resellers, and regulators, could claim access to commercial documents related to software licenses, including those related to used licenses.
